  • Atenuantes lo hicieron acreedor a una pena sustitutiva: Tras nueve años ocurrido el delito en la comuna de Panquehue, la Fiscalía llevó a juicio al acusado quien fue declarado culpable por el Tribunal Oral de San Felipe, siendo sentenciado a 800 días de presidio.

Por el delito de Abuso Sexual en contra de una niña de 7 años, fue declarado culpable por el Tribunal Oral en Lo Penal de San Felipe, un adulto mayor identificado como Misael Del Carmen González Pinto, de actuales 74 años de edad, siendo condenado a 800 días de Presidio Menor, accediendo a una pena sustitutiva de libertad vigilada intensiva.
Tras la acusación del Fiscal del Ministerio Público de San Felipe, Alejandro Bustos Ibarra, se logró establecer que el delito ocurrió el año 2008 en la comuna de Panquehue, luego que el entonces imputado abordara a la niña para trasladarla a otro sector, procediendo a efectuarle tocaciones en su cuerpo de índole sexual.
Finalmente los jueces de este Tribunal dictaron una sentencia condenatoria en contra del acusado, tras las declaraciones de la víctima, su madre y abuelo, además de la perito del Cavas y funcionarios policiales, quienes realizaron diligencias investigativas como tomar la declaración del imputado, el que reconoció el delito, aportando los antecedentes necesarios para el caso.
No obstante, el Tribunal Oral de San Felipe, en su fallo condenatorio, reconoció como circunstancias atenuantes a favor del sentenciado, la colaboración sustancial a la investigación, además de la irreprochable conducta anterior. En definitiva, el imputado fue condenado a la pena de 800 días de Presidio Menor en su grado medio; «como no tiene condenas anteriores accedió a una pena sustitutiva de libertad vigilada intensiva manteniendo las condiciones que debe cumplir como la prohibición de acercarse a la víctima», precisó el Fiscal Alejandro Bustos Ibarra a Diario El Trabajo.
